Some Actual Forensic Accounting Expert Witness Cases Involving Robert Farias

Homeowner vs. The City During the reconstruction of his home, a client was involved in a political dispute with the city in which he resided. The city canceled his building permits during his renovations forcing him to stop rebuilding for a year while his house sat with no roof or walls. Farias was retained to help determine the damages the homeowner incurred by the city’s poor decision and proved the homeowner had suffered significant losses (more than $1,000,000). Agreeing with these findings the jury actually moved to award the homeowner 50% more than was asked for.

Family Members vs. Family Members One set of relatives approached another set to put a banquet hall business together as partners. The group of family members who agreed to fund and build the business up believed their cash did not seem to be flowing correctly so Farias was brought in to determine why the business wasn’t earning as much money as it should and spending much more than seemed necessary. Through his analysis he found the other family members responsible for purchasing food and paying the bills were embezzling several hundred thousand dollars diverting finances from the banquet hall partnership to another independently-owned company.

Clothing Store vs. Insurance and Municipal Bus Companies A bus crashed into a car in a downtown intersection forcing the automobile through plate glass windows of a men’s clothing shop. The store owner claimed huge losses due to ruined product and being forced to close his business for a month. Farias was hired by both the car insurance and bus companies to determine what the actual damages sustained by the store really were as opposed to what the business was claiming. He discovered the store owner was exaggerating the amount of damages to his sellable product by attempting to claim losses on out-of-date items. By analyzing the clothing store’s previous financial statements Farias also concluded what the actual expected loss would be for the period of time the store was closed.

State Prosecution vs. Business Owner A state prosecutor claimed that a business owner was performing illegal activities and wanted to seize what they believed to be ill-gotten gains. These organizations were trying to take the business owner’s home, car and cash. Farias was asked to make sure the business owner was treated fairly and to disprove the theory that his gains were all ill-gotten by showing that his client also had plenty of legal ventures. Farias proved how much the business owner earned legitimately and the authorities were denied the opportunity to seize his assets.
