Expert Witness Bio

For the past 35 years, Robert Farias has served as President and Chief Executive Officer of the successful accounting firm Farias-Jett & Company. Like most accounting practices, Farias-Jett provides tax and accounting services for an array of different types of businesses and industries, but Community Pharmacies have always been and continue to be their primary focus. Since 1975, eighty percent of Farias’ business has consisted of aiding community pharmacies; because of his unique and vast experience, he has become well-known in this industry and retained as a trusted Pharmacy Expert Witness for the past three decades, serving as a designated or recognized Court Expert in pharmacy matters on dozens of cases. He has also assisted as a Consultant looking for flaws and/or discrepancies through evaluating other experts’ work and providing a knowledgeable second opinion.

Farias received his Bachelor of Science in Business Administration from California State University, Los Angeles (CSULA) in 1974. Upon passing the CPA exam the following year, he was hired to perform pharmacy accounting. Since then he has overseen the preparation of more than 40,000 pharmacy financial statements throughout the Western Region of the U.S. and possesses broad knowledge through his work with thousands of drug store income tax returns and reports. Decades of experience dealing with community pharmacy owners regarding inventory, cash flow, profitability, internal control, even software development design, has allotted Farias experience that exceeds most other accountants in this particular field. His office has been involved in hundreds of tax, insurance and provider audits and assisted dozens of clients regarding the sale or acquisition of their pharmacies. Farias has represented pharmacy owners in defense of allegations by federal and state agencies, been engaged on numerous Medi-Cal, Internal Revenue Service, Board of Equalization, Franchise Tax Board and insurance audits, and performed extensive forensic work to determine pharmacy losses. He has served as a Pharmacy Expert Witness in court matters including embezzlement, which have resulted in convictions and prison terms, as well as defending owners against Medi-Cal and Department of Health Services (DHS) overbilling accusations and audits, attempts to terminate provider licenses, disputes with business associates and loss of value.

Farias has become a strong advocate for pharmacy owners, who have seen their profits cut due to lack of control over the pricing mandated by insurance companies along with state and federal agencies. He works diligently and is highly effective at reconstructing pharmacy accounting records presented as evidence though he never allows his advocacy to compromise his ethical standards. His company has developed several proprietary programs and processes allowing them to perform parallel audit assessments using the same techniques used by state agencies. As a result, they have been able to efficiently anticipate audit results and provide clients with information necessary to accurately rebut and/or contradict the findings of agency auditors.

He has also met with many state representatives and officials, including representatives of the Governor’s office and senior representatives of the California Senate Judiciary Committee on matters of abuse by the State DHS and has worked with lobbyists on efforts for new legislation to force them to operate on the same basis as other federal and state agencies regarding assessments, audits and investigations of community pharmacies.
